Transfers of Property
When a property is sold by a Seller to a Buyer the change of ownership must be recorded in the Deeds Office. This process also includes certain statutory requirements that must be in place before registration of the Transfer can register in the Deeds Office. To this end a Conveyancing Attorney must be appointed to attend to this process of registering the change of ownership in the Deeds Office. The Conveyancing Attorney must also ensure that the rights of the parties to the Sale Agreement (Contract) is protected and that the Transfer is not registered without securing the Purchase price payable by the Purchaser. We are specialists in this process and will guide you every step of the way, from the signing of the contract until successful registration in the Deeds Office.
Registration and Cancellation of Bonds
When a home owner requires finance from a bank (a loan) to secure the purchase price of his property, the bank will register a Mortgage Bond against the property to protect the bank’s interest in the property, as the property will serve as security for the loan. In turn when that same home owner sells the property, the bank will not consent to cancel their Mortgage Bond and give up their security, unless they are guaranteed that the amount owed to the Bank will be settled before the property is transferred to the new owner.
To this end the Bank will instruct a Conveyancing Attorney to act on their behalf to assist either with the registration or the cancellation of the Mortgage Bond, as the case may be. We are on the panels of all the major banks and act daily for the banks in the registration and cancellation of Mortgage Bonds. We will assist you every step of the way and guide you through the paper work that must be signed until the successful registration or cancellation of the Mortgage Bond in the Deeds Office.
Consolidation and Subdivision of Property and Developments such as Township Establishments
KVV Inc. acts for many Property Developers who instruct us to assist with Consolidation or Subdivision of Properties, as well as the process of Township Establishment. We are involved throughout the entire development process and work together with the Developer, the Town Planner and the Land Surveyor to finalize the process as quickly and efficiently as possible. We will draft all the legal Conveyancing paperwork that is required to be signed by the Developer and the Municipality (if applicable) and will see the process through until registration in the Deeds Office and proclamation of the Township. We also attend to the transfers of the various stands from the developers to the end buyers thereof.
Opening of Sectional Title Registers
KVV Inc. acts for many Property Developers who instruct us to assist with the Opening of Sectional Title Registers. We are involved throughout the entire development process and work together with the Developer, the Town Planner and the Land Surveyor to finalize the process and open the Sectional Title Register in the Deeds Office as quickly and efficiently as possible. We will draft all the legal Conveyancing paperwork that is required to be signed by the Developer as well as any ancillary documents that is required in order to see the process through until registration in the Deeds Office. We also attend to the transfers of the various units from the developers to the end buyers thereof.
